A fair dismissal is one that takes place because of:
- your conduct;
- your capability or qualifications for the job;
- retirement at age 65 or the organisation's normal retirement age;
- redundancy; or
- a legal requirement that prevents the employment being continued (e.g. you are employed as a driver but no longer hold a driving licence).
If the reason is not one of these five, but there was some other substantial reason that justified your dismissal, then it can still be a fair dismissal.
